A man strangled his wife then cut her throat eight times with a box cutter. He left her to bleed to death in their western Sydney home.
It was argued that he was provoked.
During the trial, the jury heard that there had been a series of domestic violence incidents in the lead-up to the killing. Friends and relatives of the victim saw her with bruises and cuts on her face.
“Ultimately being told by his wife that she no longer loved him … was the trigger for the offender killing his wife,” Justice McClellan said.
The jury accepted the lesser plea of manslaughter, the man was sentenced to 8 years imprisonment with a non-parole period of 6 years. With time served he will be eligible for release in 2015.
The victim’s sister said Australia had “very, very bad laws … They didn’t have any proof [of provocation]. They didn’t show anything in the court.”
